Sealing of Record pursuant to Ohio Revised Code §2953.31 through §2953.61
This section deals with the expungement of an individual's record, and procedures for what needs to be done in order to file all official documents with the court.
What must I do to request an expunging of records?
In order to file a sealing of a record, you will need to obtain an application for expungement. Felony and Felony reduced to a misdemeanor applications can be obtained from either this website, or from the Annex building, Suite 4101. You will also have to pay a $50.00 non-refundable fee for any records of a case in which you were convicted.
How long will I have to wait before I can have my record expunged?
The waiting period differs depending on the outcome of the case against you. The waiting periods are as follows:
• Misdemeanor - One (1) year after final discharge
• Felony - Three (3) years after final discharge
• Ignored Case - Two (2) years after Grand Jury report ignoring
case
• Dismissal or Acquittal - No waiting period
**DUI's are not eligible for expungement!**
Where do I file my motion to expunge my records?
The original and three copies of your application will need to be filed in the Seneca County Clerk of Court's Office located at 117 E. Market Street, Suite 4101, Tiffin, Ohio. You will also need to file an Ohio Attorney General's form regarding the sealing of records with your claim to the Court. That form can be found here on our website.
Please note that all requests will take about 4-6 weeks to process and notification of the hearing will be mailed to the applicant. The court will prepare all appropriate expungement entries.
